Welcome to kulay! These Terms of Service ("Terms") govern your use of the kulay website and the services offered on it (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
1. Use of the Service
kulay provides a suite of tools for discovering, generating, and managing color palettes. The Service is provided for both personal and commercial use, subject to the conditions outlined in these Terms.
- You may browse, generate, and save color palettes for your projects.
- You may download palettes in various formats as provided by the Service.
- You must not use the Service for any illegal or unauthorized purpose.
2. User-Generated Content
You are responsible for the color palettes you create and save using the Service ("User-Generated Content"). Since kulay does not require user accounts, all saved content is stored locally on your device's browser storage. We do not claim ownership of the palettes you create.
By "loving" a palette, you contribute to a public, aggregated count of its popularity. This is an anonymous interaction.
3. Intellectual Property
The Service and its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of kulay and its licensors. The curated palettes provided in our gallery are for inspiration and use in your projects, but the palette collections themselves are the intellectual property of kulay.
4. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. We provide tools like a contrast checker, but we do not guarantee that any palette will meet specific accessibility standards (e.g., WCAG). It is your responsibility to verify compliance for your use case.
In no event shall kulay, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the company is based, without regard to its conflict of law provisions.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
